MyJourneys — Terms and Conditions
Version 0.1 — 2026-04-19 — DRAFT FOR REVIEW
Draft notice. This is an internal drafting document. It has not been reviewed by qualified UK or EU counsel. Do not publish to
myjourneys.appor present these terms to paying users until legal review is complete. Consumer-rights clauses (cancellation, refunds, limitation of liability) in particular need a lawyer's eyes.
In plain English (non-legal summary)
- MyJourneys is a subscription travel-planning and journaling app. You pay, you get access. If you cancel, you keep access until the end of the period you paid for, and you are not billed again.
- You own what you write and the photos you upload. We need a limited licence to host and display them so the app works, and that's all.
- If you are a new customer in the UK or EU, you have a 14-day statutory right to cancel your first payment and get a refund. Outside of that, we do not refund unused time, except where the law says we must.
- Beta-price subscribers ($7.99/month or $59.99/year) who stay continuously subscribed keep the beta price for life. Cancel and resubscribe later and you pay the then-current standard price.
1. Who these terms are with
These terms form a binding agreement between you (the user) and the operator of MyJourneys.
- Today (sole trader phase): MyJourneys is operated by Andrew Samuels, trading as MyJourneys, a sole trader registered in the United Kingdom. Contact:
hello@myjourneys.app. - Planned transition: MindRoam OÜ, an Estonian private limited company formed via the Estonian e-Residency programme, will take over as the operator and counterparty to these terms once incorporation and operational handover complete. When that happens we will:
- Update these terms with the OÜ's full registered details.
- Notify registered users at least 30 days in advance by email.
- Bump the version and date at the top.
- Your rights will not be reduced as a result of the transition. If the change is material, you may cancel your subscription without penalty.
(What this means: the name on the counterparty changes once the Estonian entity is set up. Your contract, price, and rights carry over.)
2. Acceptance
By creating a MyJourneys account, ticking the "I accept" box at signup, or using any part of the service, you agree to these terms and to the Privacy Policy and Cookie Policy. If you do not agree, do not use the service.
3. Who can use MyJourneys
- You must be at least 16 years old to create an account. (We pick 16 as a conservative threshold because several EU member states set the digital-consent age there.)
- You must be legally capable of entering a contract in your country of residence.
- You must provide accurate signup information and keep it current.
- One account per person. Shared accounts are not supported and may be suspended.
4. What MyJourneys does
MyJourneys is a travel-planning and journaling application. At MVP (v1) it offers:
- Onboarding and preference profiling.
- AI-generated travel guides covering Sights, Tastes, and Practical information slices.
- Text-and-photo journal entries.
- Offline cache of your generated guide.
- Read-only auto-compiled scrapbook from your journal entries.
- Paid subscription via Stripe.
We may add, change, or remove features over time. We will not remove a feature that is critical to how the service was sold to you without giving you reasonable notice and, where appropriate, a refund for the unused portion of your subscription.
4.1 Service availability and limitations
- MyJourneys is provided on an "as available" basis. We target high uptime but do not guarantee uninterrupted service.
- AI-generated guides are suggestions, not professional travel advice. They may contain factual errors, out-of-date information, or recommendations that are not suitable for your circumstances. Always verify opening hours, visa requirements, health-and-safety information, and bookings independently before acting.
- MyJourneys is not a booking engine in v1. Any booking you make is between you and the third-party provider directly.
(What this means: if the AI says a restaurant is open Mondays, check before you fly. We are a planning companion, not a travel agent.)
5. Your account
- You are responsible for keeping your login credentials secure. Use a strong, unique password, and turn on Google sign-in security features if you sign in via Google.
- Tell us immediately at
hello@myjourneys.appif you suspect unauthorised access. - We may suspend or terminate an account that is used to abuse the service, other users, our staff, or our infrastructure (see Section 10).
6. Subscription, pricing and billing
6.1 Pricing
Beta pricing (in effect from launch through approximately Sprint 19, late 2026):
- Monthly plan: USD $7.99 per month.
- Annual plan: USD $59.99 per year (equivalent to ~$5.00/month).
Standard pricing (from approximately Sprint 20 onward, date to be announced):
- Monthly plan: USD $9.99 per month.
- Annual plan: USD $79.99 per year.
Prices are shown in USD and are subject to your local currency conversion by Stripe at time of payment. Applicable VAT or sales tax will be added at checkout where required.
6.2 Grandfather clause (beta-price lock-in)
If you subscribe during the beta period and remain continuously subscribed, your price is locked at the beta rate for the life of your subscription. "Continuously subscribed" means:
- No gap between renewals of more than 14 days (to accommodate a failed payment retry).
- No cancellation followed by a new signup — a fresh signup after cancellation pays the then-current standard price.
If we change the beta-rate lock rules in future, any change will apply only to new subscribers; existing beta subscribers keep the protection they signed up for.
(What this means: subscribe now, stay subscribed, and you keep $7.99/$59.99 even after the price goes up. Cancel and come back later — you pay the new price.)
6.3 Billing
- Subscriptions auto-renew at the end of each billing period (monthly or annual).
- You are billed in advance for each period.
- Payments are processed by Stripe. We do not see or store your card details.
- If a payment fails, Stripe will retry. If retries fail, we will email you, and access may be suspended until payment succeeds.
6.4 Price changes (other than the beta-to-standard transition)
If we change the price of your plan outside the beta-to-standard transition described above, we will:
- Give you at least 30 days' notice by email.
- Let you cancel before the new price applies.
6.5 Taxes
Prices may be quoted exclusive of VAT or equivalent sales tax. The final price at checkout will reflect any tax we are required to collect.
7. Cancellation and refunds
7.1 Cancellation — any time
You may cancel your subscription at any time in settings or by emailing hello@myjourneys.app. Cancellation:
- Takes effect immediately — you will not be billed again.
- Gives you access to the paid service until the end of the current billing period.
- Does not trigger a partial refund for unused days, except as set out in Section 7.2 or 7.3.
7.2 UK and EU statutory 14-day cancellation right (first payment)
If you are a consumer resident in the UK or EU, you have a 14-day cooling-off period starting the day after you first subscribe. During this period you may cancel your first payment without giving a reason and receive a full refund. Email hello@myjourneys.app within 14 days of signup to exercise this right.
Exception: if you have actively used the paid service during the cooling-off period (for example, generated guide content, created trips), we may retain a proportionate amount equal to the value of what you have used, as permitted by consumer-rights rules. We will make this clear before processing the refund.
(What this means: try the paid version for 14 days. If you change your mind and haven't really used it, we refund. If you used it heavily, we may keep a proportionate amount.)
7.3 Other refunds
Outside the 14-day right, we do not refund unused subscription time, except:
- Where we materially break these terms and cannot fix it within a reasonable time.
- Where applicable consumer law requires a refund.
- As a goodwill gesture at our discretion.
7.4 What happens to your data on cancellation
Cancelling your subscription does not delete your account or your content. You can still sign in and view your existing trips and journals on a read-only basis (feature scope TBC). To delete your data, delete your account (Privacy Policy, Section 7 and 10).
8. Your content
8.1 You own your content
You retain all rights in the trips, itineraries, journal entries, photos, ratings, and other materials you create or upload ("Your Content"). You do not transfer ownership to us.
8.2 Licence you grant us
To run the service, you grant MyJourneys a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, and back up Your Content solely for the purpose of providing the service to you. This licence:
- Lasts only as long as Your Content is stored in MyJourneys.
- Ends when you delete the content or your account (subject to the 30-day grace and backup purge windows in the Privacy Policy).
- Does not give us any right to sell, sublicense, publish externally, or use Your Content for marketing without your explicit separate consent.
(What this means: we need a licence to put your photos on a screen so you can see them. We do not take ownership, and we cannot use your trip journal in an advert without asking you first.)
8.3 Your responsibilities for content
You promise that:
- You have the right to upload what you upload (for example, you took the photos or you have permission).
- Your Content does not infringe anyone's copyright, trademark, privacy, or other rights.
- Your Content does not contain unlawful, threatening, abusive, or defamatory material.
We may remove content that breaks this promise (see Section 10).
9. AI-generated content
MyJourneys uses AI (OpenAI and/or Anthropic) to generate personalised travel guide content from your preferences.
- Licence to you: the AI-generated guide content delivered to you is licensed to you for your personal use inside the MyJourneys service.
- You may not resell, redistribute as a standalone product, or present AI-generated guide content as your own work for commercial purposes.
- No warranty of accuracy: AI content can be wrong. Treat it as a starting point and verify independently.
10. Acceptable use
You agree not to:
- Use MyJourneys for unlawful purposes.
- Upload malware, attempt to gain unauthorised access, or disrupt the service.
- Scrape, reverse-engineer, or systematically extract data from the service.
- Use the service to harass, threaten, or harm others.
- Impersonate others.
- Use the service in ways that breach the terms of our processors (for example, feeding Stripe chargeback-fraud patterns, or feeding our AI providers prohibited content categories under their acceptable-use policies).
We may suspend or terminate accounts that break this section. Where appropriate we will warn first; for serious breaches we may act immediately.
11. Intellectual property (ours)
The MyJourneys name, logo, website, app code, design system, and documentation are owned by the operator (Andrew Samuels today; MindRoam OÜ after transition). You get a licence to use the service; you do not get ownership of MyJourneys itself.
12. Service changes and termination
- We may change, suspend, or discontinue the service or any part of it, with reasonable notice where practical.
- If we discontinue a paid feature central to your subscription, we will refund the unused portion of the period you paid for.
- If we shut down MyJourneys entirely, we will give at least 30 days' notice and provide a data export.
- You may terminate your account at any time.
13. Limitation of liability
Nothing in these terms limits or excludes our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot be limited or excluded under applicable law (including your statutory rights as a consumer).
Subject to that:
- We provide MyJourneys "as is" and do not warrant it will be error-free or meet every need.
- We are not liable for indirect, consequential, or special losses (for example, lost profits, missed flights, cancelled trips, loss of business opportunity).
- Our total aggregate liability for all claims in any 12-month period is capped at the greater of (a) the amount you paid us in subscription fees in that 12-month period, or (b) GBP £100 (or local equivalent).
(What this means: if something goes wrong, we stand behind the service to the tune of what you paid us. We are not on the hook for you missing a flight because the AI got the departure terminal wrong. Check your flights.)
14. Indemnity
You agree to indemnify and hold the operator harmless against claims, damages, and costs arising out of Your Content breaching Section 8.3 (your content responsibilities) or your breach of Section 10 (acceptable use). This does not apply to the extent the loss results from our own breach of these terms or applicable law.
15. Third-party services
MyJourneys integrates with third-party services (Google for sign-in, Stripe for payments, OpenAI and Anthropic for AI content). Your use of those services is governed by their own terms:
- Google:
policies.google.com - Stripe:
stripe.com/legal - OpenAI:
openai.com/policies - Anthropic:
anthropic.com/legal
We are not responsible for what those services do on their own platforms.
16. Governing law and jurisdiction
- While Andrew Samuels (sole trader) is the operator: these terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
- Once MindRoam OÜ is the operator: these terms will be governed by the laws of Estonia, with disputes subject to Estonian courts.
- Consumer rights carve-out: nothing in this section deprives consumers of the protection of mandatory consumer-law rules in their country of habitual residence. EU consumers may also use the European Commission's online dispute resolution platform at
ec.europa.eu/consumers/odr.
17. Changes to these terms
We may update these terms when the product, our processors, or legal obligations change. The version and date at the top tells you which version is live. For material changes, we will notify registered users by email at least 14 days before the change takes effect, and give you the option to cancel if you do not agree.
18. Miscellaneous
- Severability: if any clause is found unenforceable, the rest of these terms remain in force.
- No waiver: if we do not enforce a clause, that does not mean we have given it up.
- Assignment: we may assign these terms as part of the planned transition to MindRoam OÜ, or in the event of a sale, merger, or restructuring. You may not assign your rights without our consent.
- Entire agreement: these terms (together with the Privacy Policy and Cookie Policy) form the entire agreement between you and us regarding the service.

Review notes for Andrew
Personal judgement calls and confirmations needed before this goes live:
- Controller / operator transition date — same point as the Privacy Policy: these terms assume a future handover to MindRoam OÜ. Decide the target date once OÜ formation is on the calendar.
- Registered addresses — sole-trader trading address and MindRoam OÜ registered office both currently placeholders.
- Pricing confirmation — Section 6.1 states $7.99 / $59.99 / $9.99 / $79.99. Confirm these are final. Confirm currency (USD vs EUR) — the MyJourneys decision memo flags currency as TBD pending the Stripe jurisdiction choice. If billing in EUR, rewrite Section 6.1 accordingly.
- Grandfather rule precise definition — Section 6.2 defines "continuously subscribed" with a 14-day failed-payment tolerance. Confirm that matches the Stripe retry settings you actually plan to use (default Stripe Smart Retries can run longer than 14 days).
- 14-day cooling-off exception — Section 7.2 allows a proportionate retention when users have actively used the paid service during the cooling-off period. This is legally defensible in the UK/EU but some operators waive it for goodwill. Decide your house position.
- Liability cap — Section 13 caps at "fees paid in last 12 months or GBP £100". Cross-check against Estonian consumer law (OÜ phase) and decide whether £100 should be EUR. A consumer lawyer may also push to raise or remove the floor.
- AI guide disclaimer strength — Sections 4.1 and 9 say the AI can be wrong and you must verify. Decide whether to strengthen this at signup with an explicit check-box ("I understand AI content can contain errors") — defensible posture for consumer-app AI in 2026.
- Acceptable use list — Section 10 has a generic list. Decide whether to add specifics relevant to MyJourneys (for example, no uploading photos of identifiable third parties without consent — relevant for journal photos).
- Content licence scope — Section 8.2 says we cannot use user content for marketing without separate consent. Consider whether you want an optional "feature my trip" opt-in in settings for future social-proof marketing, built as an explicit consent toggle separate from these terms.
- Refunds policy discretion — Section 7.3 leaves goodwill refunds to your discretion. As a solo operator this is fine but you need a simple internal rule so you are consistent.
- ODR link (EU) — Section 16 references the EU ODR platform. Verify the platform's ongoing status in 2026 (there have been proposals to sunset it).
- Counsel review — UK consumer-contract law (Consumer Rights Act 2015, CCRs 2013) and Estonian consumer law both have specific drafting expectations. Get this reviewed before the paywall goes live.
